Warranty Policy
I. General Provisions
Perason Company Limited (hereinafter referred to as the “Manufacturer”) guarantees that the conveyor belts supplied by the Manufacturer in individual components (hereinafter referred to as the “Product”) are free from material defects, meet current technical and production standards, and possess the characteristics agreed upon with the Buyer/User.
The Manufacturer ensures that the Product operates correctly, safely, and reliably, provided that it is used for its intended purpose and in compliance with these warranty terms as well as the conditions for transport, operation, and storage.
The warranty applies separately to each component of the delivered Product.
II. Warranty Period
The warranty period for each component of the Product is specified on the warranty card or Certificate issued by the Manufacturer on the date of sale, calculated from the date the belt component is delivered to the customer.
For each repair mentioned in Section V.2.a), the warranty period will be extended by the duration during which the Buyer/User was unable to use the Product due to the defect.
III. Obligations of the Buyer/User
The Buyer/User is obligated to use the purchased Product only on conveyor systems operated in accordance with the Manufacturer’s technical documentation and operating instructions, as well as current technical knowledge in the field.
The Buyer/User is responsible for selecting the correct Product for the cooperating equipment, particularly conveyor systems. The selection must be made by a person or organization with appropriate technical qualifications. All risks arising from incorrect selection of the Product for cooperating equipment shall be borne by the Buyer/User.
The Buyer/User is responsible for any unauthorized changes to the operating conditions of the Product, including changes to the technical configuration or operating parameters of the conveyor system that may directly or indirectly affect the Product’s lifespan. Unauthorized changes also include failure to notify the Manufacturer that the Product—whose characteristics were subject to agreement—will be used on a conveyor system with non-standard configuration or equipment.
IV. Scope of Warranty
The Manufacturer is liable to the Buyer/User only for material defects or non-compliance of the Product with the specifications stated in the Certificate/Warranty Card issued on the date of sale, provided such defects arise from inherent causes of the Product and are discovered within the warranty period specified in the Certificate/Warranty Card.
The warranty does not cover defects or damage resulting from causes other than Product defects, including:
- Use of the Product contrary to its intended purpose or improper use.
- Damage resulting from selecting a Product unsuitable for current operating conditions.
- Damage caused by improper transport or storage.
- Damage resulting from incorrect installation or improper belt connection.
- Damage caused by incorrect selection or operation of cooperating equipment or other devices affecting the Product.
- Damage resulting from accidental events or force majeure.
The warranty does not cover natural wear and tear of the Product during normal use.
The warranty does not apply to Products whose origin from the Manufacturer cannot be clearly verified based on submitted documents and identifiable characteristics.
V. Rights of the Buyer/User
The Buyer/User has the right to file a complaint in the event of discovering hidden physical defects or non-compliance with the specifications stated in the Certificate/Warranty Card. The Manufacturer’s liability is limited to the value of the defective Product at the time of sale/delivery.
If the complaint is deemed justified, the Manufacturer shall provide one of the following remedies, taking into account the specific circumstances of each case:
- Free rectification of the defect (Product repair).
- If repair is impossible or not feasible, an alternative solution will be agreed upon between the Manufacturer and the Buyer/User, provided that its value does not exceed the value of the claimed Product minus depreciation, calculated as follows:
Where:
- Vco – compensation value (net PLN)
- Vpp – purchase value of the Product (net PLN)
- Tserl – actual service life (months)
- Twarr – warranty period (months)
If replacement of a defective belt section is required, the new belt will be delivered within the agreed timeframe, and the warranty period for the replacement belt will follow the original warranty period.
VI. Complaint Submission Procedure
Only the Buyer/User is entitled to submit a complaint regarding the Product.
To be accepted for review, the following conditions must be met:
- The complaint must be submitted within 7 days from the discovery of the defect, provided the defect is found within the warranty period.
- The complaint must be submitted in writing or via email.
- The complaint must include at least:
- Product type and code, purchase date and location.
- Date of defect discovery and detailed description of the defect.
- Available documentation (including photos) enabling identification of the Product’s origin.
- Contact details of the authorized representative handling the complaint.
- Technical and operating documentation of the conveyor system.
- Product Certificate/Warranty Card.
- Buyer/User expectations regarding the complaint.
The Manufacturer is not responsible for delays in complaint processing caused by missing, incomplete, or inaccurate information.
A complete and effective complaint submission is required to initiate the review process.
The Manufacturer shall review the complaint without unnecessary delay.
During the review process, the Manufacturer will analyze the submitted complaint, take necessary actions (including contacting the Buyer/User’s representative), and—if required—arrange an on-site inspection.
These actions must be performed within 3 business days.
The Manufacturer shall issue a decision within 30 days from receipt of the complaint, unless additional actions such as laboratory testing or expert consultation are required. In such cases, the deadline will be extended accordingly.
During the review process, the Manufacturer’s representative has the right to:
- Access technical and operating documentation of the conveyor system.
- Inspect the installation site and operating conditions of the defective Product.
- Access information on the type and volume of materials transported by the conveyor.
- Collect samples from the defective Product and prepare additional photographic documentation.
Obstructing these activities constitutes grounds for rejecting the complaint.
If the information provided in the complaint is found to be false, the Manufacturer may reject the complaint and charge the Buyer/User for costs incurred during the review.
If the complaint is accepted, the Buyer/User shall receive the remedies specified in Section V.
Submitting a complaint does not exempt the Buyer/User from fulfilling contractual obligations, including payment for purchased Products.
VII. Force Majeure
The Manufacturer is not liable for failure or improper performance of obligations, nor for damages incurred by the Buyer/User, resulting from force majeure events.
In the event of force majeure, the timeframe for warranty service will be extended by the duration of the event and the time required to resume suspended work.
The affected party must immediately notify the other party of the occurrence and cessation of the force majeure event.
VIII. Final Provisions
The Buyer/User’s rights under these warranty terms shall be excluded if the Buyer fails to pay for the Manufacturer’s Products within the agreed timeframe.
This warranty does not exclude, limit, or suspend the Buyer/User’s statutory rights regarding defects of sold Products.
All disputes arising from these warranty terms shall be resolved by the court having jurisdiction over the Manufacturer’s registered office.
